 To this end, the bill was passed in the Haryana Legislative Assembly. The bill, however, has a waiver clause which, if a suitable local party is not available for a particular industry, can be taken from another state party.


  CHANDIGARH: The Haryana government on Thursday passed a bill to give 75% reservation to local candidates to apply for private sector jobs in the state for jobs with a salary of Rs 50,000 per month.

 

  Introduced by Deputy Chief Minister Dushayant Chautala (Minister of State for Labor), the bill does not find a suitable local candidate but one-point agencies can apply.  In such cases, they can inform the government of such steps and then take partisans from outside.






  However, as it is enshrined in Articles 14 and 19 of the Constitution (equality before the law and the right to practice in any profession) in India, the bill - the recruitment of local candidates in the state of Haryana - requires the consent of President Ram Nath Kobind before it is enacted.


  The Haryana government has said that the choice of local candidates will be "desirable" socially, economically and environmentally, referring to "competition for low-wage jobs, large numbers of immigrants" and then "impact on local infrastructure and housing ... and expansion of slums".


 The bill appoints a "designated officer" to act as a representative of the government who will take care of the companies applying for exemptions with exemptions as per the demand of suitable candidates.



  According to the bill, this officer can claim to invalidate the waiver claim by instructing the concerned agency to “train local candidates to acquire the desired skills, qualifications or skills”.


  Under the provisions of this bill, companies must register details of all employees receiving gross monthly wages of less than Rs 50,000 per month.  It has to be done within three months of the bill becoming law or there is a provision to collect a fine of Rs 25,000 to Rs 1 lakh



  Once the bill law is changed, companies will be forced to fill 75% of the jobs by local candidates.  Companies can limit employment by 10% from any one district.  Violation of this provision is punishable by a fine of Rs 50,000 to Rs 2 lakh.


  During the Assembly election campaign in October last year, Mr. Chautala promised to save 75%.  Mr Chautala and his JJP are in third place - behind the BJP and the Congress - but he has forged a last-ditch alliance with the former to form a government.


  In July, Mr Chautala said in the ordinance that it only applies to companies with more than 10 employees.  He said: "It will help the residents to get employment in the states. Similar laws exist in other states and we need to create employment in Haryana".


  The JJP chief pointed to the big automobile Maruti, which has a manufacturing plant at Manesar near Delhi, and said: "Maruti does not even have 20 per cent workers from Haryana".


  He added, "We are committed to creating employment in the state so that GST is generated in the state as well."


  The Deputy Chief Minister further said that residential certificates are mandatory for candidates to avail this facility under the scheme.
