New Delhi: The Supreme Court on Wednesday stayed the Bombay High Court's (HC) decision in a 'disturbing' manner.  Where it was stated that raping a minor girl without touching her body is not a measure of sexual abuse under the Child Abuse Act (POCSO).


 Attorney General KK Venugopal issued a statement on January 19, in a judgment delivered by a single judge of the Nagpur Bench of the Bombay HC.  Following the order, the court acquitted a man accused of raping a 12-year-old girl.  The appellate High Court acquitted him of the charge and sentenced him to one year imprisonment under section 354 of the IPC on the charge of indecency only.


 A three-judge bench headed by CJI SA Bobad has issued notice to the accused and the Maharashtra government to reply within two weeks.  "Meanwhile, we have upheld the acquittal order of the accused under Section 8 of the Pocso," the bench comprising Justices AS Bopanna and V Ramsubramaniam said.



 "The order is very offensive and will probably set a dangerous precedent," AG said.  He is against the order.
